Terms and Conditions for Driving Lessons with YouDrive Learner Driver Training
INTRODUCTION
The following terms and conditions represent the basis upon which driving lessons and courses are offered to you by your YouDrive driving instructor. Please note the contract for service is between yourself and the instructor.
DRIVING LICENCE AND EYESIGHT REQUIREMENTS
The learner must hold a current, valid driving licence (provisional or full) which must be produced on or in advance of their first lesson. The learner must also check that they can read a number plate at a distance of 20.5 metres (i.e 57 feet – about 5 car lengths) with glasses or contact lenses if normally worn.
PAYMENTS
Payment for lessons will be made in cash or by cheque (supported by bank guarantee card) and made payable to the instructor at the start of every lesson. Block bookings are to be paid at the start of the first lesson in order to benefit from the discount offered.
Intensive Courses and Pass Plus
A minimum 25% deposit will be required at the time of booking for any intensive or fast track courses taken, the balance payable 14 days prior to the course start date. Please note deposits paid for such courses are not refundable for any reason. However, should you need to cancel the course more than 14 days prior to commencement the deposit will be held and can be transferred to any course rebooked and taken within 8 weeks of the agreed original start date.
The full course fee is payable for any courses cancelled 14 days or less from the start date Once a booking has been accepted by your YouDrive instructor a binding agreement is made between you and them. This does not in any way affect your statutory rights to be provided with the goods and services you have bought.
PICK-UP AND DROP-OFF POINTS
All lessons will start and finish at the same location unless other arrangements are made with your YouDrive instructor. If you elect to finish at a different location, your instructor may need extra traveling time to get to the next appointment. If this is the case, the lesson may have to finish early.
LESSON POSTPONEMENT
To enable your YouDrive instructor to rebook another pupil you will be required to give 48 hours notice of cancellation of a lesson, otherwise we regret that the lesson will be charged.
YouDrive is not responsible in the unlikely event that your lesson or training is postponed due to traffic conditions, adverse weather conditions, mechanical breakdown of vehicle or any other cause outside of our control.
TIME KEEPING
In their own interests learners are advised to be punctual for their lesson appointments. All such appointments should be recorded (and checked where possible by their local YouDrive instructor) in their student appointment record to ensure that mistakes are avoided. The YouDrive instructor would normally wait for a maximum of 10 minutes before the lesson would be abandoned and the lesson fee forfeited or become due for payment. A reciprocal waiting time may become necessary if the YouDrive instructor is delayed due to unforeseen circumstances. Any lesson lost as a result of this would be made up by the instructor either at the end of the normal lesson time if possible or at a later date. All efforts will be made to inform the pupil of a delayed start time to a lesson.
CODE OF CONDUCT
All YouDrive instructors are bound by a professional code of conduct. Your YouDrive instructor will be courteous, polite, tidy and punctual. He or she will also behave in a professional and ethical manner at all times. Your instructor’s car will be well maintained, clean and tidy. All cars used by YouDrive instructors are fitted with dual-controls as part of their standard equipment. The cars are of course fully insured for driving tuition. YouDrive instructors will not smoke in the car at any time, nor will they use your lesson time for any other form of business personal or otherwise.
Your YouDrive instructor will be licensed by the Driving Standards Agency (DSA) to give driving tuition. Your instructor will also keep up to date with changes in driving law and current best practice for driving tuition. Instructors are subject to periodic checks by the DSA to maintain quality and have also been checked and cleared by the Criminal Records Bureau.
THE DRIVING TEST
Bookings
Driving tests can be booked by you or your instructor on your behalf. Driving test bookings always take priority over other lessons. Therefore, your lesson may be postponed to allow for someone else’s driving test and vice-versa. Changes to lesson bookings as a result of this will be notified immediately. Test appointments must be notified to your YouDrive instructor as soon as they are known, otherwise he or she cannot guarantee to provide a vehicle for the test.
Use of the Vehicle
Very rarely and in the interests of road safety, YouDrive reserves the right to withhold the use of the school car for the driving test if, in the opinion of your instructor, you are not able to control the car safely.
Practical test cancellation
Three clear working days notice of cancellation or postponement (not including Sundays and public holidays) is required by the DSA. Failure to provide the required notice will result in the loss of your test fee.
Your YouDrive instructor cannot be held responsible for any postponement or cancellation of tests by the DSA, and therefore in the event of this occurrence a 2 hour lesson will be charged.
SAFETY
In the interests of comfort and safety learners are advised to wear suitable footwear and clothing which does not restrict movement. Learners must take note of any medication they are taking that may affect their ability to drive safely and advise their instructor accordingly before taking a lesson booked. If your instructor believes you to be under the influence of alcohol or drugs then the lesson will be abandoned and full payment will be due. This will be non-negotiable.
Personal Property
YouDrive Learner Driver Training accepts no liability for personal property that is left in any training vehicle.
Mobile Phones
All pupils should ensure that these are switched off, prior to entering the tuition vehicle.
COMPLAINTS
In the event of a complaint all efforts must be made to resolve the problem directly with your YouDrive instructor. However, please do not let a problem linger. If a satisfactory conclusion cannot be reached, you can pursue the matter with the ADI registrar at the Driving Standards Agency.
